Terms of Service

These Terms are an agreement between you and Genius Creations Inc., operating as Landscape Genius ("we," "us," or "the Service"). By creating an account or continuing to use the Service you agree to them. If you do not agree, do not use the Service.
1. The Service
Landscape Genius is a two-sided platform connecting homeowners with independent landscaping contractors. We provide AI-assisted concept visualisation, quoting, proposal and invoicing tools. We are not a party to any contract you enter into with another user, we do not perform landscaping work, and we do not supervise, employ or guarantee any contractor.
2. Eligibility and accounts
You must be at least 18 and, if you are acting for a business, authorised to bind it. Provide accurate information and keep it current. You are responsible for all activity under your account and for keeping your credentials confidential. Tell us immediately at support@landscapegenius.app if you suspect unauthorised access.
3. Contractor and homeowner responsibilities
Contractors are responsible for their own licensing, insurance, workmanship, safety and compliance with local regulations, and for reviewing every quote before sending it — a proposal you send is your professional quote, not ours. Homeowners are responsible for the accuracy of measurements, photos and scope descriptions they submit, and for satisfying themselves about any contractor they engage.
4. AI-generated output
AI concepts, scope suggestions and reference ranges are conceptual and may be inaccurate or incomplete. They are not engineering, horticultural, legal, insurance or tax advice and are not a guarantee of the finished work or its cost. You remain responsible for verifying output before relying on it or sending it to a customer. Full detail is in the AI Disclaimer, which forms part of these Terms.
5. Acceptable use and community standards
You must not misuse the Service — including unlawful use, fraud or fraudulent listings, spam, harassment, infringing another party's intellectual property, scraping, circumventing credit or plan limits, or probing our security. Our Community Guidelines form part of these Terms and set out content and conduct rules, reporting, blocking and enforcement.
6. Content and licence
You retain ownership of photos, descriptions and other content you upload, and you confirm you have the right to upload it. You grant us a limited, worldwide, non-exclusive licence to host, process, display and generate AI concepts from your content solely to operate and improve the Service. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan; you may not resell it, reverse engineer it, or circumvent its technical limits. We retain all rights in the Service, its software and branding.
7. Payments, subscriptions and credits
Contractor subscriptions and Genius Credits are billed according to the plan selected in-app. Fees are exclusive of taxes unless stated. Subscriptions renew each period until cancelled. See the Refund Policy for cancellation and refunds.
Our order process for web purchases is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and cancellation mechanics for those orders are governed by Paddle's Buyer Terms. Purchases made inside our mobile apps are transacted by Apple or Google under their terms.
8. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment, a security or fraud risk, or serious or repeated policy violations. You may stop using the Service and delete your account at any time — see Account deletion. On termination your access ends; records we must keep by law (such as issued invoices) are retained as described in the Privacy Policy.
9. Disclaimers
The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation, that any contractor will accept a project, that any homeowner will hire you, or that an AI concept will match a physical outcome.
10. Limitation of liability
To the maximum extent permitted by law, we exclude liability for indirect, consequential or special damages, including lost profits, lost data or lost goodwill, and our total aggregate liability for any claim arising from your use of the Service is limited to the amounts you paid us in the 12 months before the claim. Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law.
11. Indemnity
You will indemnify us against claims arising from your content, your work for or engagement of another user, your unlawful use of the Service, or your breach of these Terms.
12. Governing law
These Terms are governed by the laws of Ontario, Canada, and the courts of Ontario, Canada have exclusive jurisdiction, without affecting mandatory consumer rights in your country of residence.
13. Changes
We version these Terms. We will notify you in-app of material changes and ask you to accept the new version; continued use after that constitutes acceptance. You may not assign these Terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control.
